Public offer

The sales contract is intended for buyers and is the official offer of the Seller at the time of the conclusion of the agreement. In order to purchase the Product, the Buyer accepts the terms of this Agreement:

1. General rules

1.1. This document is a public offer contract (according to Articles 633, 641 AND Chapter 54 of the Civil Code of Ukraine). Its Terms and Conditions are the same for Buyers regardless of whether they are natural persons, legal entities or individuals. a person is an entrepreneur.

1.2. As for the acceptance of the terms of this contract, ie. of the Seller's public offer, the consumer becomes a Buyer.

1.3. By concluding the Agreement, the Buyer confirms that he has read and agrees with the proposed terms. The Buyer gives permission for the Seller to process his personal data regarding mutual settlements, receipt of invoices, acts and other documents.
The permission to process personal data is valid for the entire term of the Agreement, as well as after its expiration.

2. Definition of terms

2.1. The seller sells goods in the store and on the website based on a license agreement for the use of the Curandero Store trademark.

2.2. The goods are the list published on the website and displayed on the store shelves, on which they can be indicated:

  • price, name and description. The product on the website is accompanied by its image
  • QR code that will lead to the product card on the website;
  • notes: hit, new, best price.

2.3. The buyer is an adult individual or legal entity/entrepreneur with legal capacity.

2.4. An order is a completed and placed application of the Buyer for the purchase of Goods, addressed to the Seller.

2.5. Access to the store website is carried out on the Internet at the address https://curandero.store/

2.6. Personal account in the form of a personal section of the Buyer on the Seller's website. Only the Buyer has access to it. His personal information and the history of placed Orders are displayed in his personal account.

3. The essence of the contract

3.1. The Seller undertakes to sell the Goods based on the Order placed by the Buyer on the store's website. The buyer undertakes to pay for the cost of the Goods.

3.2. The Seller guarantees that the Goods have not been pledged, are not in dispute, under arrest and are not subject to the rights of third parties.

3.3. Seller and Buyer confirm that this agreement is not a fictitious agreement or one made by deception or influence.

3.4. The seller confirms that he has permits for economic activity and guarantees that he has the right to sell the goods without restrictions, in accordance with the requirements of the legislation of Ukraine, and undertakes to bear responsibility in case of violation of the Buyer's rights.

3.5. The buyer accepts the terms of the contract when placing an order by clicking the "Buy" button. In the future, objection from the Buyer relieves the Seller of responsibility for non-fulfillment of the terms of this contract and reserves the right of the Seller to cancel the Order unilaterally.

4. How to communicate with the website of the online store

4.1. The buyer can view the content of the Internet store website, place an order, participate in promotions, raffles, and also use other services.

4.2. Registration is required for the Buyer's access to personal information and the provision of additional opportunities for working with the Internet store site.

4.3. During registration, the Buyer enters the following data:

  • Full name.
  • Phone number.
  • Email address.
  • Address of actual residence.

4.4. The buyer undertakes to provide accurate information about himself. The Seller is not responsible for the correctness of the data provided by the Buyer when placing the Order.

4.5. The buyer is responsible for his actions on the store website under his account and on his behalf.

4.6. The Seller has the right to refuse the Buyer to complete the Order if the Buyer has violated the terms of this contract.

5. How to issue an Order

5.1. The Buyer places the Order himself on the store's website, adding the selected Goods to the virtual basket and clicking the "Buy" button.

5.2. Registered and unregistered Buyers can place an Order for Goods.

6. Cost and terms of payment

6.1. The price of the Product is determined by the Seller and indicated on the website of the online store. The total cost of the Order is determined by adding up the price of all the Goods included in the Order and the cost of delivery.

6.2. The amount of the Order may vary depending on the price, quantity or nomenclature of the Goods.

6.3. The buyer chooses a convenient payment method at his discretion:

  • for cash,
  • by non-cash settlement,
  • electronic payment,
  • through a payment terminal.

6.4. Payment is made in hryvnias.

6.5. The order is considered paid from the moment the funds are received on the bank account of the seller or his representative. The fact of payment of the Order indicates the Buyer's agreement to the terms of this contract.

6.6. Delivery of the Order by the Seller is carried out after full payment of the Goods.

6.7. The price of the Product, indicated on the store's website, can be changed unilaterally by the Seller.

6.8. The product is not reserved until the Buyer's funds are credited to the Seller's current account. If it is necessary to return the funds, the Buyer must inform the Seller of the details of the bank account to which the money must be transferred.

7. Under what conditions is the return made

7.1. If the price of the ordered Product does not correspond to reality. The Seller is obliged to inform the Buyer in order to confirm or cancel the Order. In the event that it was not possible to contact the Buyer, the Order is canceled automatically. If the Order has been paid, the Seller returns the paid amount to the Buyer to the Buyer's bank account in accordance with the procedure and terms established by the legislation of Ukraine.

7.2. When placing an Order, the Buyer agrees that he has the right to refuse the Order in full, and not in part.

8. What the Seller undertakes to do

8.1. Provide reliable information about the Goods, cost and delivery conditions.

8.2. Guarantee conformity of the quality of the Goods within the borders of Ukraine.

9. What the Buyer undertakes to do

9.1. Provide the Seller with true and accurate information about yourself.

9.2. Pay for the Goods at the price specified in the Orders.

9.3. When buying, carefully inspect the product and packaging. In the presence of a representative of the delivery service, open the packaged purchase and check the preservation of the package, make sure there is no damage. Sign the invoice (receipt, register, etc.) about receiving the Order.

9.4. If there are complaints, request the representative of the delivery service to draw up an Act of external inspection and an Act of acceptance-handover in 3 copies. The inspection report describes the damage to the outer packaging, and the receipt-handover report describes the defects in the individual packaging of the product.

9.5. If the assortment, completeness or packaging of the Goods is violated during the purchase, — inform the Seller about the defects no later than 5 (five) days from the moment of purchase or receipt. The item is returned in merchandise form with all labels, seals and documentation intact.

9.6. Provide passport data to receive the Order at the office of the courier company, and appear in person with an identity document.

10. What can the Buyer do?

10.1. Demand the return of payment for the Goods if the Seller does not fulfill the terms of the Order.

10.2. Change the Order before its payment.

10.3. Timely submit claims to the quality of the Goods in accordance with the Law of Ukraine "On the Protection of Consumer Rights".

11. Responsibility of the Buyer and the Seller

11.1. The Seller is not responsible for damage to the Buyer if he improperly used the Goods.

11.2. The Seller is not responsible for late fulfillment of Orders and its obligations if the Buyer has provided false information about himself.

11.3. The Seller and the Buyer are equally responsible for fulfilling their obligations under this Agreement in accordance with the legislation of Ukraine.

11.4. The Seller and/or the Buyer are not responsible for non-fulfillment of their obligations in the event of force majeure: war, hostilities, earthquake, flood, fire, actions of state authorities, changes in customs regulations, restrictions on import and export, which have arisen regardless of the will of the Seller and/or the Buyer after concluding this contract. The Party that cannot fulfill its obligations shall immediately notify the other Party and provide the documents issued by the authorized bodies.

12. Personal data protection policy

12.1. By providing his personal data, the Buyer voluntarily agrees to the processing and use of information about himself without limiting the term of the Agreement.

12.3. The seller uses personal data to provide and promote services.

12.4. The Seller undertakes to keep confidential the information received from the Buyer, except in cases where the disclosure of personal data is established by the requirements of the law.

12.5. The Seller is not responsible for failure to fulfill its obligations if the information about the Buyer does not correspond to reality.

13. Newsletters and information messages

13.1. By registering on the website of the online store, the Buyer gives the Seller consent to receive SMS and messages to his e-mail.

13.2. The buyer can unsubscribe from receiving the newsletter at any time in the body of the newsletter (by clicking on the "Unsubscribe" link at the bottom of the email). You can also call the number indicated on the website (according to the operator's tariffs).

14. Secondary conditions

14.1. This contract is valid within the framework of the legislation of Ukraine.

14.2. Disputes between the Buyer and the Seller are resolved through negotiations. If it was not possible to settle the differences, the Buyer or the Seller can go to court to resolve the disputed issue.

14.4. The Seller has the right to make changes to the text of this contract at its own discretion at any time and without prior notice to the Buyers. Current information in the contract is always available on the website of the online store.
